About modification of some legal acts of Ukraine concerning strengthening of control of leave of medicines
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Article 78-1 of Bases of the legislation of Ukraine about health care (Sheet of the Verkhovna Rada of Ukraine, 1993, No. 4, Art. 19; 2013, No. 23, Art. 223; 2021, 8, the Art. 59) to add No. with Item 5 of the following content:
"5) to appoint medicines, implementable (released) from drugstores, their structural divisions according to requirements of the legislation for the recipe of the doctor, without writing out of the recipe to such medicines by the rules established by the central executive body which provides forming and realizes state policy in the field of health care.
Provisions of this Item extends only to health workers.
2. Part third of article 21 of the Law of Ukraine "About medicines" (Sheets of the Verkhovna Rada of Ukraine, 1996, No. 22, Art. 86; 2012, 30, 348) to state No. to the Art. in the following edition:
"The realization (leave) to citizens of medicines according to the recipe of the doctor is enabled according to the procedure, established by the central executive body which provides forming and realizes state policy in the field of health care. It is forbidden to enable the realization (leave) to citizens of medicines, implementable (released) according to requirements of the legislation for the recipe of the doctor, with violation of established procedure, including without recipe, according to the recipe which is written out with violation of requirements of the legislation and/or at which effective period expired (invalid to the recipe)".
3. In the Law of Ukraine "About drugs, psychotropic substances and precursors" (Sheets of the Verkhovna Rada of Ukraine, 2007, No. 10, Art. 89 with subsequent changes):
