1. This Instruction disaggregates procedure for rendering by courts of the Republic of Kazakhstan for legal assistance and procedure for the request for legal assistance to courts of foreign states.
2. The instruction is developed according to regulations of the Code of civil procedure of the Republic of Kazakhstan (further - GPK), the Code of penal procedure of the Republic of Kazakhstan (further - the Code of Criminal Procedure) and the international treaties ratified by the Republic of Kazakhstan (further the international treaty).
3. According to the current legislation of the Republic of Kazakhstan and the international treaty courts of the Republic of Kazakhstan perform the messages of courts and other competent organizations of foreign states delivered by it in accordance with the established procedure about production of separate legal proceedings (delivery of notices and other documents, receipt of explanations of the parties, witnesses, production of examination and survey on site, etc.) and can address courts and other competent organizations of foreign states for legal assistance.
4. Provisions of this Instruction are not applied if the international treaty provides other procedure for rendering legal assistance and the request for legal assistance to courts of foreign states.
5. The orders of courts of foreign states which arrived from Committee on judicial administration under the Supreme Court of the Republic of Kazakhstan (further - Committee), are performed by courts of the Republic of Kazakhstan.
The orders of courts and other competent organizations of foreign states which arrived directly in courts are subject to execution with the notification on it of Committee.
