About modification and amendments in the order of the Minister of health and social development of the Republic of Kazakhstan of May 5, 2015 No. 319 "About approval of Rules of appointment and payment of public welfare payments to the families having children"

I ORDER:

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of May 5, 2015 No. 319 "About approval of Rules of appointment and payment of public welfare payments to the families having children" (it is registered in the Register of state registration of regulatory legal acts for No. 11507) the following changes and amendments:

state preamble in the following edition:

"According to the subitem 1) of article 3-1 of the Law of the Republic of Kazakhstan "About public welfare payments and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER to the families having children":";

in Rules of appointment and payment of public welfare payments to the families having the children approved by the specified order:

the fifth to state the paragraph to part two of Item 1 in the following edition:

"the monthly public welfare payment granted and paid to mother or the father, the adoptive father (adopter), the guardian (custodian) who is bringing up the child with disability (children with disability) (further – benefit bringing up the child with disability);";

in Item 2:

4) to state the subitem in the following edition:

"4) the receiver – the applicant who is granted allowance for the birth, attendance allowance and (or) extra family allowance and (or) benefit bringing up the child with disability and (or) benefit of mother having many children;";

9) to state the subitem in the following edition:

"9) the list of the main requirements to rendering the state service – the requirement the including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service;";

17) to state the subitem in the following edition:

"17) the electronic request – the data necessary for purpose of benefit for the birth, attendance allowances, extra family allowances, benefits bringing up the child with disability and the benefit of mother having many children in electronic form certified by the digital signature of the State corporation;";

state Item 5 in the following edition:

"5. For purpose of benefits for the birth and on leaving the applicant addresses to authorized body to destination of benefits through the State corporation or on the portal with the statement in form according to appendix 1 to these rules with the enclosed documents specified in the list of the main requirements to rendering the state service "Purpose of Benefits for the Birth of the Child and on Child Care" according to appendix 1-1 to these rules.

Submission of the statement for purpose of benefits for the birth and on leaving is not required in case of purpose of benefit through pro-active service according to the Law of the Republic of Kazakhstan "About the state services".

Data of the identity document of the applicant, the certificate (certificate) on the birth of child(children) or the statement from the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration, the certificate on the conclusion (termination) of scrap (matrimony), the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, the data on registration at the place of residence specified in the electronic statement of the applicant receive from the corresponding state information systems through lock of "the electronic government" (further – information systems) according to requests in information systems of state bodies and (or) organizations according to appendix 2 to these rules.

For purpose of benefits for the birth and on leaving submission of the certificate of birth of child(children) or the reference containing data from civil registrations on the birth, certificates on the conclusion, annulment of marriage (matrimony), except for the data on marriage (matrimony) registered outside the Republic of Kazakhstan and also the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, data on bank account number is not required in case of confirmation of information containing in the specified documents according to requests in information systems of state bodies and (or) the organizations according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and also other data taking into account features of provision of the state service is provided in the list of the main requirements to rendering the state service "Purpose of Benefits for the Birth of the Child and on Child Care", according to appendix 1-1 to these rules.

In case of registration of the birth of child(children) at the choice of uslugopoluchatel the state service "Purpose of Benefits for the Birth of the Child and on Child Care" is rendered by the principle of "one statement".";

"7. For purpose of extra family allowance the documents specified in the list of the main requirements to rendering the state service "Purpose of Extra Family Allowance" according to appendix 3-1 to these rules are enclosed to the application in form according to appendix 3 to these rules.

For purpose of extra family allowances, submission of the certificate of birth of child(children), the certificate on the conclusion, annulment of marriage (matrimony), except for the data on marriage (matrimony) registered outside the Republic of Kazakhstan, the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, and also data on study on internal department of educational institution, data on bank account number are not required in case of confirmation of information containing in the specified documents according to requests in information systems of state bodies and (or) the organizations according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering and also other data taking into account features of provision of the state service is provided in the list of the main requirements to rendering the state service "Purpose of Extra Family Allowance" according to appendix 3-1 to these rules.";

state paragraph 3 in the following edition:

"Paragraph 3. Procedure for purpose of benefit bringing up the child with disability

11. In case of primary establishment of disability to the child, the applicant addresses for purpose of benefit to MSE which is bringing up the child with disability in division at the place of residence with the statement in form according to appendix 3 to Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization, the approved order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 (registered in the Register of state registration of regulatory legal acts for No. 11110) (further – the Order No. 223).

In case of disability establishment the state service "Purpose of Benefit of Mother or to the Father, the Adoptive Father (Adopter), the Guardian (Custodian) Who Is Bringing Up the Child with Disability" is rendered to child(children) at the choice of uslugopoluchatel by the principle of "one statement".

Submission of the statement for purpose of benefit bringing up the child with disability is not required in case of purpose of benefit through pro-active service according to the Law of the Republic of Kazakhstan "About the state services".

12. The allowance bringing up the child with disability is granted from the date of the appeal to authorized body to destination of benefit directly either through the State corporation or on the portal for the entire period of disability of the child.

In case of determination of the child with disability the benefit bringing up the child with disability is appointed to complete state providing during finding of the child on vacation in family, on condition of documentary confirmation of this fact by public institution in which the child stayed on complete state providing.

13. The allowance bringing up the child with disability is granted irrespective of the income of family of the child.

14. For purpose of benefit bringing up the child with disability to the statement presented at the place of residence, in form according to appendix 5 to these rules the documents specified in the list of the main requirements to rendering the state service "Purpose of Benefit of Mother or to the Father, the Adoptive Father (Adopter), the Guardian (Custodian) Who Is Bringing Up the Child with Disability" according to appendix 5-1 to these rules are attached.

Data of the identity document of the applicant, the certificate (certificate) on the birth of child(children) or the statement from the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration, the certificate of disability of the child, the certificate on the conclusion (termination) of scrap (matrimony), the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, data on registration at the place of residence, the data on bank account number specified in the electronic statement of the applicant receives from the corresponding state information systems according to requests in information systems of state bodies and (or) organizations according to appendix 2 to these rules.

For purpose of benefit bringing up the child with disability submission of the certificate of birth of child(children) or the statement from the birth record, the certificate on the conclusion, annulment of marriage (matrimony), except for the data on marriage (matrimony) registered outside the Republic of Kazakhstan, the certificate of disability of the child, and also the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, data on bank account number is not required in case of confirmation of information containing in the specified documents according to requests in information systems of state bodies and (or) the organizations according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering and also other data taking into account features of provision of the state service is provided in the list of the main requirements to rendering the state service "Purpose of Benefit of Mother or to the Father, the Adoptive Father (Adopter), the Guardian (Custodian) Who Is Bringing Up the Child with Disability" according to appendix 5-1 to these rules.";

state Item 19 in the following edition:

"19. For purpose of the benefit of mother having many children to the statement provided at the place of residence, in form according to appendix 7 to these rules the documents specified in the list of the main requirements to rendering the state service "Purpose of Public Welfare Payment to the Mothers Having Many Children Awarded with Suspension Brackets " Three-copecks Piece of Alg ", " Kum_s of Alg " or Who Were Entitled Earlier "Mother Heroine", Awarded with the Degree Awards "Maternal Glory" I and II" according to appendix 7-1 to these rules are attached.

The data proving the identity and registration at the place of residence of the applicant receive from the corresponding state information systems according to requests in information systems of state bodies and (or) organizations according to appendix 2 to these rules.

Submission of the document on rewarding or receipts of rank of the mother having many children awarded with suspension bracket "Three-copecks piece of alg", "Kum_s of alg" or who was entitled earlier "Mother heroine", awarded with the awards "Maternal Glory" I and II of degree, data on bank account number is not required in case of confirmation of information containing in the specified documents according to requests in information systems of state bodies and (or) the organizations according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering and also other data taking into account features of provision of the state service is provided in the list of the main requirements to rendering the state service "Purpose of Public Welfare Payment to the Mothers Having Many Children Awarded with Suspension Brackets " Three-copecks Piece of Alg ", " Kum_s of Alg " or Who Were Entitled Earlier "Mother Heroine", Awarded with the Degree Awards "Maternal Glory" I and II" according to appendix 7-1 to these rules.";

state Item 24 in the following edition:

"24. In case of the request of the applicant for purpose of benefits for the birth and (or) on the leaving which is bringing up the child with disability by means of the portal request in information systems of state bodies and (or) organizations for confirmation of the provided data and receipts of the necessary data provided in the application form according to appendices 11 and 12 to these rules it is performed by the applicant.

In case of receipt of confirmatory data the applicant who performed request by means of the portal certifies the EDS the electronic statement for purpose of benefit for the birth and (or) on leaving and (or) bringing up the child with disability and sends it to the automated information system of authorized state body.

In case of submission of required documents by the applicant in "personal account" of the applicant the status about acceptance of request for rendering the state service is displayed.";

subitems 5), of Item 25 to state 6) and 7) in the following edition:

"5) age of the child concerning which the allowance bringing up the child with disability is granted, not exceeding eighteen years (for purpose of benefit bringing up the child with disability);

6) disability availability at the child (for purpose of benefit bringing up the child with disability);

7) availability of registration of the permanent residence of the applicant and child(children) with disability (for purpose of benefit bringing up child(children) with disability).";

to state part one of Item 26 in the following edition:

"26. The division of MSE within one working day from the date of adoption of the statement on purpose of benefit bringing up the child with disability sends to department of the State corporation the electronic request consisting of the statement and document package, stipulated in Item 14 these rules including electronic copies of the documents submitted by the applicant in the original.";

to state part one of Item 38 in the following edition:

"38. Attendance allowances, bringing up the child with disability, are paid to large family and mother having many children monthly, for current month.";
