About introduction of amendments to the Law on the small and medium companies No. 179/2016

The Parliament adopts this organic law.

Art. I. - In the Law on the small and medium companies No. 179/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 306-313, 651), with subsequent changes, to make the following changes:

1. In Article 4:

in Item b) parts (the words "50 million lei" to replace 1) in both cases with the words "100 million lei";

part (to recognize 2) invalid.

2. In Article 5:

part (to state 1) in the following edition:

"(1) Depending on the annual average number of workers, annual turnover or total volume of the assets belonging to them the small and medium companies are classified by the following categories:

a) the microcompanies - the companies numbering workers no more than 9 people, annual turnover to 18 million lei or the total volume of the assets belonging to them to 18 million lei;

b) small enterprises - the companies numbering workers no more than 49 people, annual turnover to 50 million lei or the total volume of the assets belonging to them to 50 million lei;

c) medium scale enterprises - the companies numbering workers no more than 249 people, annual turnover to 100 million lei or the total volume of the assets belonging to them to 100 million lei.";

add Article with part (3) the following content:

"(3) If for date of submission of annual financial reports the company does not belong to that category which was appropriated to it according to the criteria established by part earlier (1), it is reclassified in other category. Reclassification of the company from lower category in higher is made only if it does not belong to lower category during two financial years in a row any more.".

Art. II. - This law becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
