About introduction of amendments to the Law on the small and medium companies No. 179/2016

The Parliament adopts this organic law.

Art. I. - In the Law on the small and medium companies No. 179/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 306-313, 651), with subsequent changes, to make the following changes:

1. In Article 3 in the concept "financial guarantee on the credit" "/to loans" to exclude the word.

2. Items f) and h) parts (Article 12 to state 3) in the following edition:

"f) banks;"

"h) pawnshops and organizations on currency exchange, other than banks;".

3. Add the law with Article 13-1 of the following content:

"Article 13-1. Fund of entrepreneurship and economic growth of Moldova

(1) the Fund of entrepreneurship and economic growth of Moldova is created as a part of public organization "Organization for Development of Entrepreneurship" with the status of the internal autonomous division which does not have the status of the legal entity.

(2) the Purpose of Fund of entrepreneurship and economic growth of Moldova is available financing of the small and medium companies through competent banks and non-bank credit institutions.

(3) the Public organization "Organization for Development of Entrepreneurship" provides to competent banks and non-bank credit institutions financial resources from financial resources of Fund of entrepreneurship and economic growth of Moldova based on the agreements signed with them and in the set financing limits.

(4) the Fund of entrepreneurship and economic growth of Moldova is financed by assignments from the government budget, from the financial resources allocated by partners in development and/or donors (credits/loans, financial and technical assistance, grants) from income gained from crediting and loaning up from the usufruct received from investment of the available financial resources from other legal sources.

(5) the Procedure for the organization and functioning of Fund of entrepreneurship and economic growth of Moldova, and also use of its financial resources are determined by the provision approved by the Government.".
