About introduction of amendments to the Law of Ukraine "About use of nuclear energy and radiation safety" concerning the radiation protection expert

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About use of nuclear energy and radiation safety" (Sheets of the Verkhovna Rada of Ukraine, 1995, No. 12, Art. 81 with the following changes) the following changes:

1. In Article 24:

to add the paragraph of the sixth after the words "which is subject to state regulation" with the words "and at persons who intend to become radiation protection experts";

add with the paragraph of the following content:

"recognizes competence of the expert in radiation protection".

2. Add with Article 34-1 of the following content:

"Article 34-1. Radiation protection expert

The radiation protection expert provides to subjects of activities in the field of use of nuclear energy, to other legal entities and physical persons, public authorities of the recommendation about questions of ensuring radiation protection of personnel and the population according to the legislation of Ukraine and taking into account the international and European standards and the practician on the civil beginnings.

The physical person having the higher education not below the second (master) level in the corresponding industry of knowledge can be the radiation protection expert, the work experience in the field of use of nuclear energy and radiation safety and conforms at least five years to qualification characteristics, requirements to amount of knowledge and practical skills in the directions of competence.

Person who is the citizen (subject) of the state, the acknowledged Verkhovna Rada of Ukraine the state aggressor or the state invader cannot be the radiation protection expert.

Qualification characteristics, requirements to amount of knowledge and practical skills in the directions of competence, procedure for recognition and deprivation of competence of the expert in radiation protection are established in provision about the radiation protection expert, affirms the Cabinet of Ministers of Ukraine.
