About introduction of amendments to the Law of Ukraine "About private international law" in connection with ratification of the protocol on the right which is applied to obligations about content

The Verkhovna Rada of Ukraine decides:

1. Introduce in the Law of Ukraine "About private international law" (Sheets of the Verkhovna Rada of Ukraine, 2005, No. 32, Art. 422 with the following changes) the following changes:

Part one of Article 9 to state 1) in the following edition:

"1. Any sending to the right of the state shall be considered as sending to regulations of the substantive right regulating the corresponding legal relationship excepting application of its conflict-of-laws rules if other is not established by the law or the international treaty of Ukraine";

Part one of Article 66 to state 2) in the following edition:

"1. The right and obligation of parents and children, except the cases provided by Articles 67, 67-1, 67-4 of this Law are determined by the personal law of the child or the right which has close connection with the corresponding relations and if it is more favorable for the child";

Article 67 to state 3) in the following edition:

"Article 67. General provisions about the right that is applied to obligations on content

1. Obligations on content which arise from the family relations are regulated by the right of the state in which person having the right to content has residence.

2. Obligation parties on content can choose the right applicable to the obligation on content, according to the rules determined by article 67-4 of this Law";

To add 4) with Articles 67-1 - 67-4 such contents:

"Article 67-1. Obligations on content between parents and children

1. If person having the right to content cannot receive it according to the right determined according to part one of article 67 of this Law, obligations on content between parents and children are regulated by the forum State right.
