About introduction of amendments to the Criminal code of Ukraine concerning enhancement of responsibility for tortures

The Verkhovna Rada of Ukraine decides:

1. Bring in the Criminal code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131) such changes:

Part the fifth Article 49 to state 1) in the following edition:

"5. The prescription is not applied in case of the making of crimes against the bases of homeland security of Ukraine provided in Articles 109-114-2, of torture provided by Article part three 127, against the world and the safety of mankind provided in Articles 437-439 and part one of Article 442 of this Code";

Article 69 part one after the words "the criminal offense connected with corruption" to add 2) with the words "for the torture made by the representative of the state, including foreign";

Article 75 part one after the words "reduce attention and speed of reaction" to add 3) with words and figures "the torture provided by part three of article 127 of this Code";

Part the sixth Article 80 to state 4) in the following edition:

"6. The prescription is not applied in case of condemnation for the torture provided by Article part three 127, the crimes against the world and safety of mankind provided by Articles 437-439 and part one of Article 442 of this Code";

Article 127 to state 5) in the following edition:

"Article 127. Tortures

1. Tortures, that is any intentional act sent on the causing to the person of severe physical pain or moral suffering made with the purpose to force it or other person to make the actions contradicting their will including to receive data or recognitions, or with the purpose to punish him or the other person for the actions made by it or other person or in making of which it or other person is suspected, or its intimidation or other persons, -

it is punished by imprisonment for a period of three up to six years.
