About modification in criminal and Criminal procedural codes of Ukraine concerning closing of criminal proceedings in connection with loss of force the law which established criminal illegality of act

The Verkhovna Rada of Ukraine decides:

1. Make changes to such legal acts of Ukraine:

1) part one of article 84-1 of the Criminal code of Ukraine (2001, 131) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 25-26, in the following edition:

"1. The convict concerning whom in term of imprisonment in the form of corrective works, arrest, restriction of freedom, content in disciplinary battalion of the military personnel, imprisonment for certain term, lifelong imprisonment by authorized body is made the decision on its transfer for exchange as the prisoner of war and which provided the written consent to carrying out such exchange is exempted by court from serving of the imposed penalty";

2) in the Criminal Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88):

5 parts one of Article 3 to add Item with the words "petition for closing of criminal proceedings";

to add article 132 after part three with new part of the following content:

"4. The resolution of the investigative judge or court on application of measures of ensuring criminal proceedings stops the action after the termination of term of its action, cancellation of measure of restraint, adoption of the verdict of not guilty or closing of criminal proceedings according to the procedure, provided by this Code.
