1. Approve the Instruction on the organization of providing and provision by the serviceman of the Armed Forces of Ukraine and members of their families of premises which is attached.

2. N20 "About Modification and Amendments in Regulations on Procedure for Providing with Living Space in the Armed Forces of Ukraine" registered in the Ministry of Justice of Ukraine on February 20, 1995 for N43/579, to consider the order of the Minister of Defence of Ukraine of February 3, 1995 invalid.

3. Responsibility for the organization and accounting, providing and provision by the serviceman of the Armed Forces of Ukraine, to members of their families of premises to provide to the chief of the Head room and operational department of the Armed Forces of Ukraine.

4. Responsibility for the organization of control over distribution of premises in garrisons of the Armed Forces of Ukraine, check of correctness of registration of accounting cases of the military personnel which need improvement of housing conditions, to provide to the deputy defense secretary of Ukraine (according to distribution of functional powers).

5. To provide control over the implementation of the order to the deputy defense secretary of Ukraine (according to distribution of functional powers).

6. Distribute the order in each separate military unit.

1. General provisions

1.1. The instruction about the organization of providing and provision by the serviceman of the Armed Forces of Ukraine and to members of their families of premises (further - the Instruction) determines the organization of providing and provision of premises by the serviceman - to persons of officer, foreman and sergeant, ordinary structure (except the military personnel of conscription service) the Armed Forces of Ukraine, including to those which pass military service in the military units, institutions, organizations and the organizations (further - military units) relating to the sphere of management of the Ministry of Defence of Ukraine in its structural divisions, and also persons transferred to the reserve or in resignation, to citizens who remained on accounting which need improvement of housing conditions in military units after dismissal (further - the military personnel) and to members of their families, including members of families of the military personnel who died, died, were missing during passing of military service which stay on the registry, to persons, which need improvement of housing conditions (further - members of their families).

1.2. Office premises which meet the requirements of the housing legislation are provided to military personnel and members of their families. For this purpose in each military unit the fund of office housing is created.

The annual number of office housing is separately determined by each garrison according to the program of creation of fund of service housing premises in the Armed Forces of Ukraine which affirms the Minister of Defence of Ukraine.

1.3. In case of lack of office housing stock in military unit the military personnel of ordinary, sergeant and foreman structure who passes military service under the contract and are not married, accommodate free of charge in specially adapted barracks in arrangement of military unit, and family - in family hostels. Domestic conditions in the specified barracks shall meet the demands which are made to the hostels intended for accommodation of lonely citizens.

For other military personnel the military unit shall lease housing for the purpose of providing with it the military personnel and members of their families or at the request of the serviceman to pay it monetary compensation for the sublease (employment) of premises in accordance with the established procedure.

1.4. Housing for permanent residence is provided to the military personnel having period of service on military service of 20 years and more and members of their families.

Military personnel who stayed on the registry of the citizens needing improvement of housing conditions before entry into force of the Law of Ukraine of June 24, 2004 of N1865-IV "About introduction of amendments to article 12 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" are provided with premises for permanent residence according to earlier established legislation rather.

1.5. Providing at the expense of the Ministry of Defence of Ukraine of military personnel and members of their families is performed by housing for permanent residence by provision once during the whole time of passing of military service of housing of the new system eliminated office, exempted or acquired at physical person or legal entity, loan granting on construction (purchase) of housing in accordance with the established procedure.

Military personnel and members of their families have the right to premises to be registered in the location of military unit, and in case of its disbandment - in the location of military commissariat.

Provision of premises by the serviceman and to members of their families is performed after delivery of living space by them which they occupied on the previous duty station (training).
