Some questions of realization of joint project with Credit institution of reconstruction (KfW) "Increase in efficiency of transmission of electricity (Upgrade of substations) in II"
The Cabinet of Ministers of Ukraine decides:
1. Recognize reasonable attraction by private joint-stock company "The national energy company "Ukrenergo" of the credit from Credit institution on rekonstruktsiyukfw, Frankfurt am Main ("KfW"), for project implementation "Increase in efficiency of transmission of electricity (Upgrade of substations) in II" in the amount of 32500000 euros under the state guarantee on the conditions determined by the draft of the Credit agreement between KfW, Frankfurt am Main ("KfW") and private joint-stock company "The national energy company "Ukrenergo" ("Borrower") for 32500000 euros, the "Increase in Efficiency of Transmission of Electricity (Upgrade of Substations) in II" project.
2. Determine that:
1) the payment for provision of the state guarantee for ensuring accomplishment of debt obligations on the loan which is attracted for project implementation "Increase in efficiency of transmission of electricity (Upgrade of substations) in II" constitutes 0,5 of annual interest rate of the chosen and outstanding credit amount;
2) private joint-stock company "The national energy company "Ukrenergo" provides ensuring execution of the obligations on the state guarantee in the procedure determined by the legislation in the amount of at least 100 percent of the amount of debt obligations on the credit with the way:
receipt of funds as a part of rate for services in transfer of electrical energy regarding components of structure of rate for repayment of the loan, payment of the commission for obligations, percent and other payment obligations on the credit;
contractual write-off of funds from accounts of private joint-stock company "The national energy company "Ukrenergo" for benefit of the Ministry of Finance upon the demand of the Ministry in the amount of the amount of debt obligations of society on the credit, linked with accomplishment of warranty obligations;
