About introduction of amendments to article 38 of the Federal law "About Privatization of the State-owned and Municipal Property"

In paragraph one of Item 1 of the word "or in case of" to replace 1) with the word", in case of", to add with words ", or in case of decision making by the Government of the Russian Federation about alienation of the shares of the joint-stock companies having strategic importance for ensuring defense of the country and safety of the state according to the Federal Law of April 29, 2008 No. 57-FZ "About procedure of foreign investments in the economic societies having strategic importance for ensuring defense of the country and safety of the state" in which the share of the ordinary shares which are in property of the Russian Federation constitutes at least 25 percent plus one share from total quantity of ordinary shares of joint-stock company being in federal property if as a result of such alienation the share of the ordinary shares which are in property of the Russian Federation decreases in total quantity of ordinary shares of joint-stock company to 25 percent and below";

"5. The special right ("golden share") is used from the moment of alienation from state-owned property of shares of the relevant joint-stock company as a result of which the share of the ordinary shares which are in state-owned property will decrease in total quantity of ordinary shares of joint-stock company to 25 percent and below, in the presence of the decision specified in the paragraph of 1 Item 1 of this Article.".
