About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:
1. Add the code with Article 76-1 of the following content:
"Article 76-1. Labor activity during stay in maternity leave
(1) In departure from Item and) articles 76 the worker has the right to continue or renew labor activity during stay in maternity leave based on its written application with submission of the medical certificate about the state of health issued by medical and sanitary organization in which list it is registered in coordination with the employer. The term during which the worker can continue or renew labor activity during stay on prenatal leave shall not exceed 36 weeks of pregnancy and is determined by the order (the order, the decision, the resolution) issued by the employer in day of receipt of the statement of the worker.
(2) Due to the giving by the worker performing labor activity during stay in maternity leave, the written application before the expiration provided by part (1) this Article of term action of the individual employment contract by order of (to the order, the decision, the resolution) the employer stops on the date of receipt of the statement with further application of provisions, stipulated in Item and) Article 76.".
2. Recognize Article 114-1 invalid.
3. Part (Article 124 to state 6) in the following edition:
"(6) the Worker has the right to return from partially paid leave on child care before achievement of age by it three years before the expiration established in specified in parts (2) or (4) the statement, having notified on it the employer by the written application in 15 working days prior to return. This term can be reduced from written consent of the parties.".
