About introduction of amendments to the Law on legal executives No. 113/2010
The Parliament adopts this organic law.
Art. I. - In the Law on legal executives No. 113/2010 (repeated publication: The official monitor of the Republic of Moldova, 2017, Art. No. 2-8, 1), with subsequent changes to make the following changes:
1. Part (Article 18 to state 9) in the following edition:
"(9) the Order of the Minister of Justice on suspension of operations of the legal executive can be appealed in degree of jurisdiction according to provisions of the Administrative code without preliminary procedure.".
2. In Article 19:
Item d) parts (to state 1) in the following edition:
"d) cancellations of the license;";
in part (2) the second offer to exclude;
part (2-1) to state in the following edition:
"(2-1) in case of imposing of authority punishment, stipulated in Item е) parts (1) Articles 24, the order of the Minister of Justice on the termination of activities of the legal executive is issued in five-day time after publication on the official web page of the Ministry of Justice of the decision of Disciplinary board on imposing of the corresponding authority punishment.";
in part (the words "and the decision of Disciplinary board on the termination of activities of the legal executive which took legal effect serve" to replace 3) with the word "serves";
add Article with parts (3-1) and (3-2) following of content:
"(3-1) Order of the Minister of Justice on the termination of activities of the legal executive can be appealed in degree of jurisdiction according to provisions of the Administrative code in 30-day time from the date of publication in the Official monitor of the Republic of Moldova without preliminary procedure.
(3-2) in case of cancellation by the final judgment of the document based on which activities of the legal executive are stopped of part provision (7) Article 18 are applied as appropriate.".
