About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:

1. To add Chapter XIII of the General part with Articles 134-23 and 134-24 of the following content:

"Article 134-23. Anticonstitutional subject

The anticonstitutional subject is understood as the expected power created in the territory of the state in defiance of the constitutional provisions of the relevant state and unrecognized according to regulations of international treaties.

Article 134-24. Illegal information structure

The illegal information structure is understood as the organization created in defiance of constitutional and precepts of law of the state for the purpose of the data collection and processing which is the state secret, other information which can be used for making of the actions causing damage to sovereignty, independence, territorial integrity, state security or defense capability of the Republic of Moldova and also for the purpose of recruitment of persons for assistance in implementation of such actions.".

2. Part (Article 289-1 to add 1) with Item h) the following content:

"h) illegal flight of airspace of the Republic of Moldova the objects used in the military purposes".

3. In Article 337:

in part (to add 1) after words of "the foreign organization" with words ", to the anticonstitutional subject";

add Article with part (1-1) following contents:

"(1-1) Acts provided by part (1), made by the public figure, the official, person who is taking up responsible state position

are punished by imprisonment for a period of 15 up to 20 years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of 10 up to 15 years.".

4. State Article 338 in the following edition:
