I ORDER:

In the order of the Deputy prime minister – the Minister of Trade and integration of the Republic of Kazakhstan of September 30, 2022 No. 389-HK "About approval of Rules of subsidizing of rate of remuneration on the issued credits and the made leasing transactions banks of the second level, Development bank of Kazakhstan, other legal entities performing leasing activities, to foreign buyers of domestic high-technology goods and services of processing industry who are subject to insurance from the single operator on promotion of non-oil export, taking into account the assumed international obligations, the list of domestic high-technology goods and services of processing industry for the purposes of subsidizing of rate of remuneration on the issued credits and the made leasing transactions by banks of the second level, Development bank of Kazakhstan, other legal entities performing leasing activities to foreign buyers of domestic high-technology goods and services of processing industry who are subject to insurance from the single operator on promotion of non-oil export" (it is registered in the Register of state registration of regulatory legal acts at No. 29930) to make the following changes:

"23. The means intended for subsidizing are listed in national currency by authorized body on the rate established by National Bank of the Republic of Kazakhstan for date of transfer of the amounts of subsidies within the funds provided on these purposes by the republican budget for the current financial year for the account of the financial agent opened in division of treasury on the basis of the contract for money transfer signed between them in the amount of the subsidized part of the rate of remuneration provided according to schedules for the corresponding financial year under credit agreements / agreements of leasing corresponding to the size.

The subsequent payments are made according to requests of the financial agent on the annual basis on requirement of subsidies for the forthcoming financial year within the acting and new credit agreements / agreements of leasing.";

"30. The creditor / the leasing company provides return of means of subsidies for the account of the financial agent opened in division of treasury, in cases:

1) the subsidizing terminations - within 5 (five) working days from the date of receipt of the decision of the financial agent on the subsidizing termination;

2) partial/complete early repayment on the credit / to the leasing transaction - within 5 (five) working days from the date of complete/partial repayment of the credit / the leasing transaction, for redirection on subsidizing of the new credit operating and/or approved to subsidizing / the leasing transaction.

At the same time the creditor / leasing company the next working day after implementation of return of remaining balance of the amounts of subsidies for the account of the financial agent sends the financial agent the letter with indication of the payable amount of subsidies and disaggregation of the amounts with the reflection of data on the borrower changed payment schedules under the credit agreement / agreement of financial leasing, the agreement of subsidizing including in the electronic Microsoft Excel format (Microsoft ex-fir-tree).".

2. To provide to department of promotion of export of the Ministry of Trade and integration of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Trade and integration of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Trade and integration of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.
