About change of the laws concerning activities of political parties and other public associations

Article 1. Bring in the Law of the Republic of Belarus of October 4, 1994 No. 3254-XII "About public associations" the following changes:

1. To state part one of Article 1 in the following edition:

"Public association is voluntary consolidation of citizens, in the procedure established by the legislation united for joint implementation and satisfaction of social, economic, cultural and other interests and achievement of the authorized purposes.".

2. In Article 2:

state part one in the following edition:

"Citizens of the Republic of Belarus have the right to create public associations, to enter and participate in activities of the operating public associations.";

in part two of the word "in the operating public associations" shall be replaced with words "and to participate in activities of the operating public associations".

3. State Articles 3 and 4 in the following edition:

"Article 3. Status of public associations, unions

In the territory of the Republic of Belarus the international, republican and local public associations, the unions, and also departments of the international public associations created in the territory of foreign states are created and are effective.

The international public association is the public association which is created in the territory of the Republic of Belarus and has organizational structures in the territory of one or several foreign states and the territory of the Republic of Belarus.

The international public association within six months from the date of its state registration in the Republic of Belarus shall create organizational structures in the territory of one or several foreign states and the territory of the Republic of Belarus and to submit supporting documents to the Ministry of Justice. The specified organizational structures are created according to the procedure, established by the charter of the international public association, and according to the legislation of the Republic of Belarus, and organizational structures in the territory of foreign state - also according to the legislation of this foreign state.

International union is the union which is created with participation of the public association created in the territory of foreign state.

Republican public association is the public association which is created in the territory of the Republic of Belarus and has organizational structures in all areas of the Republic of Belarus and the city of Minsk. The specified organizational structures shall be created according to the procedure, established by the legislation and the charter of republican public association, within six months from the date of state registration of republican public association.

The republican union is the union created with participation of republican public association.

Local public association is the public association created in the Republic of Belarus taking into account requirements of this Law and which is not meeting the requirements specified in parts two and the fifth this Article.

The local union is the union created by local public associations.

In case of failure to carry out provided by parts three and the fifth this Article of requirements about creation of organizational structures the public association shall change the status within two months.

Change of the status of public association, union is performed by entering into the charter of public association, the union of changes and (or) amendments according to the procedure, established by this Law, and their submissions to the Ministry of Justice, head department of justice of regional, Minsk city executive committee for state registration.

Departments of the international public associations created in the territory of foreign states are their isolated structural divisions which are created in the territory of the Republic of Belarus. Such departments are effective according to the procedure, established for the international public associations, taking into account the features provided by articles 8 and 13 of this Law.

Article 4. Basic principles of creation and activities of public associations, unions

Public associations, the unions are created and act on the basis of liberty principles of consolidation, democratism, legality, publicity, voluntariness, independence, self-government and equality of all public associations, unions.".

4. To add article 6 after part one with parts of the following content:

"The state can render to public associations, the unions information, methodical and other support.

The state support of public associations, unions is based on the principles of legality, partnership, transparency, equality, coordination and responsibility.".

5. To state part one of Article 7 in the following edition:

"Creation and activities of public associations, unions for the purpose of violent change of the constitutional system, propaganda for war, social, race, religious and racial hatred, implementation of terrorist and other extremist activities, other acts prohibited by the legislation, or allowing possibility of implementation specified activities and acts during achievement of the lawful purposes of creation are prohibited.".
