About modification of some legal acts of the Kyrgyz Republic in the field of state registration of the rights to real estate and transactions with it

Article 1.

Bring in part I of the Civil code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1996, No. 6, the Art. 80) the following changes:

Paragraph one of Item 3 of Article 328 to state 1) in the following edition:

"3. The pledge agreement of real estate is subject to state registration and does not require the obligatory notarial certificate.";

In paragraph three of Item 1 of Article 335 of the word which is "notarially certified" to exclude 2).

Article 2.

Bring in the Law of the Kyrgyz Republic "About state registration of the rights to real estate and transactions with it" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1999, No. 4, the Art. 193) the following changes:

in Article 47-2:

a) in the name of Article to replace the word of "agreements" with the word of "transactions";

b) state Item 1 in the following edition:

"1. Registration of the rights to real estate arising based on the transactions which are not requiring the obligatory notarial certificate is performed by local registration body.";

c) and 5 to state items 4 in the following edition:

"4. The specialists of local registration body authorized on making of actions for registration of the transactions which are not requiring the obligatory notarial certificate in case of making by them of the actions contradicting the legislation of the Kyrgyz Republic bear responsibility in the procedure established by the law.
