About practice of use of the provisions of the law by courts about proofs and proof on civil cases
For the purpose of ensuring the correct and uniform use of the provisions of the law by courts about proofs and proof on civil cases, being guided by article 17 of the Law "About Courts", the Plenum of the Supreme Court of the Republic of Uzbekistan decides:
1. Explain to courts that according to Article of 71 GPK proofs on civil case are understood as any actual data on the basis of which in the procedure determined by the law the court establishes availability or lack of circumstances on which prove the requirements and objections of the party, and also any other circumstances important for the correct permission of case. These data can be received from:
explanations of the parties and third parties;
testimonies of witnesses;
written and physical evidences;
digital proofs
;expert opinions;
consultations (explanations) of specialists.
2. The court of data on the circumstances important for case should understand the message as explanations of the parties and the third parties specified persons and their representatives.
Explanations of the parties, the third parties and their representatives can be this both orally, and in writing, and also are received by use of systems of video conferencing according to the procedure, stipulated in Clause 209 GPK.
