About practice of collection of court costs on economic cases

For the purpose of remedial action, the court costs which are available in court practice on collection on economic cases, based on article 17 of the Law "About Courts", the Plenum of the Supreme Court of the Republic of Uzbekistan decides ensuring the correct application by courts of the legislation on the specified question:

1. Courts should mean that court costs on economic cases consist of the state fee and costs connected with consideration of the case.

2. According to part one of article 3 of the Law of the Republic of Uzbekistan "About the state fee" (further - the Law "About the State Fee") the state fee is understood as the obligatory payment levied for making of legally significant actions and (or) issue of documents by the organizations authorized on that and (or) officials.

As the state fee, along with other types of obligatory payments, is component of forming of the income of the Government budget of the Republic of Uzbekistan, courts need to observe strictly requirements of the law on collection of the state fee for economic cases.

3. Explain that the state fee on economic cases is collected:

1) from the filed a lawsuit actions for declaration;

2) from statements for recognition of legal entities and physical persons insolvent;

3) from declarations of accession to case in quality of the third party declaring independent requirements regarding dispute;

4) from statements for establishment of the facts important for origin, change or the termination of the rights of legal entities and individual entrepreneurs in the economic sphere;

5) from statements for contest of decisions of reference tribunal;

6) about issue of writ of execution on forced execution of decisions of reference tribunal;

7) from statements for recognition and carrying out of the foreign judgment (arbitration);
