About preparation of civil cases for legal proceedings
For the purpose of ensuring the correct and uniform use of the provisions of the law regulating preparation of civil cases for legal proceedings, being guided by article 17 of the Law of the Republic of Uzbekistan "About courts", the Plenum of the Supreme Court of the Republic of Uzbekistan decides:
1. Draw the attention of courts that preparation of civil cases for legal proceedings is the independent stage of civil process aiming to provide their correct and timely consideration and permission, and obligatory on all cases of claim and special proceeding.
According to the Code of civil procedure of the Republic of Uzbekistan (further - GPK) the court has the right to start consideration of the case only after accomplishment all 21 GPK of actions for preparation of case for legal proceedings provided by Chapter.
2. The judge shall start preparation of case for legal proceedings only after removal of determination about adoption of the statement to production and initiation of proceedings (Article of 201 GPK).
3. About preparation of case for legal proceedings the judge according to Article 204 GPK shall take out determination, having specified in it specific legal proceedings which should be made to the parties and other persons participating in case, and terms of making of these actions. In determination also actions of the judge in this stage of process are specified.
Determination about preparation of case for legal proceedings as not excluding possibility of further movement put, is not subject to appeal.
