About modification of the Order of the Government No. 1136/2007 about some measures for execution of the Law No. 419/2006 on debt of the public sector, the state guarantees and the state recrediting

Based on article 1 of the Law No. 419/2006 on debt of the public sector, the state guarantees and the state recrediting (repeated publication: The official monitor of the Republic of Moldova, 2014, Art. No. 397-399, 704), with subsequent changes, DECIDES: the Government

1. In the Order of the Government No. 1136/2007 about some measures for execution of the Law No. 419/2006 of year on debt of the public sector, the state guarantees and the state recrediting (Official monitor of the Republic of Moldova, 2007, Art. No. 175-177, 1216), with subsequent changes, to make the following changes:

1) in all text:

a) "The law No. 419-XVI from on December 22, 2006 about debt of the public sector, the state guarantees and the state recrediting" in any grammatical form to replace the text with the text "Law No. 419/2006 on debt of the public sector, the state guarantees and the state recrediting" in the corresponding grammatical form;

b) "The law No. 397-XV from on October 16, 2003 about local public finance" in any grammatical form to replace the text with the text "The law No. 397/2003 on local public finance" in the corresponding grammatical form;

c) words of "registration on accounts" in any grammatical form shall be replaced with words "records on accounts" in the corresponding grammatical form;

2) in appendix No. 1 to the resolution:

a) add Item 1 with the text "/guarantees of the state/municipal companies and commercial societies with completely or mainly public capital";

b) in Item 3 of the word "all debts" to replace with the text "data on the cost corresponding to each tool generating debt of the public sector";

c) in item 4:

after the text "/guarantees of administrative and territorial units" to add Item with the text "/guarantees of the state/municipal companies and commercial societies with completely or mainly public capital";

to replace the word of "loan" with the word of "debt";

d) in Item 5:

replace the word "debts" with the word to "debt";

to replace the word of "loan" with the word "agreements";

e) in Item 7:

to "all internal and/or external loans" to replace the text with the text to "all tools generating debt of the public sector";

add Item with the text "/guarantees of the state/municipal companies and commercial societies with completely or mainly public capital.";

The first reporting of the state/municipal companies and commercial societies with completely or mainly public capital and administrative and territorial units is submitted to the Ministry of Finance within 10 days from the date of agreement signature and/or provision of a guarantee according to appendix No. 1 to this Provision, and also the copy of the agreement signed by the debtor and the creditor in case of loans. In case of provision of a guarantee by administrative and territorial units, the state/municipal companies and commercial societies with completely or mainly the public capital for loans the guarantor represents the copy of the agreement on provision of a guarantee and the copy of the loan agreement.";

h) in Item 10 of the word of "the state and municipal companies" to exclude;

i) in Item 11-1:

"Creditor banks" shall be replaced with words words "Resident Creditors";

after the words "on loans" to add Item with the words "for term there is one year and more";

j) state Item 11-2 in the following edition:

"11-2. Bodies of the central and local public authority and public bodies as founders of the state/municipal companies and as shareholders of commercial societies with completely or mainly the public capital represent to the Ministry of Finance the list of subjects which obtained loans for one year and more and provided guarantees for loans for one year and more, with indication of data on remaining balance of debt and the name of the creditor, to the 25th which is directly following reporting quarter.";

k) add appendix with Items 11-3 and 11-4 of the following content:

"11-3. Administrative and territorial units, the state/municipal companies and commercial societies with completely or mainly the public capital represent to the Ministry of Finance the quarterly reporting on the guarantees provided by them for loans for the term of one year and more according to appendix No. 6 to this Provision.

11-4. The National Bank of Moldova, banks with completely or mainly public capital which have obligations in the form of deposited money represent to the Ministry of Finance the quarterly reporting on the attracted deposits for the term of one year and more, with charge or without charge on them of percent, or with receipt of any other benefit according to appendix No. 7 to this Provision.";

l) "/guarantees of administrative and territorial units" to add Item 12 after the text with the text "/guarantees of the state/municipal companies and commercial societies with completely or mainly public capital";

m) to add Item 15 after the words "and remaining balance of the state guarantees" with the text "/administrative-territorial units / the state/municipal companies and commercial societies with completely or mainly public capital";

n) in appendix No. 1 to the Provision:

- in the Report:

to add the name after the word of "loans" with the text "/guarantees";

recognize Items 12-15 invalid;

the words "Signature of the Director" shall be replaced with words "The signature of the head of the subject";
