In the country consecutive reforms on establishment of effective judicial control behind activities of state bodies and officials, and also to increase in level of achievement of justice of citizens and subjects of entrepreneurship, ensuring functioning of republican executive bodies and executive bodies on places, officials according to the Constitution and the laws of the Republic of Uzbekistan are undertaken.
At the same time the Strategy of development for New Uzbekistan in judicial system provides expansion of scope of judicial control by means of enhancement of system of consideration of claims to decisions of officials in administrative courts, ensuring strict observance of procedure according to which the proof obligation in administrative court of legality of the decision, action (failure to act) is assigned to the official who accepted it, and also implementation of effective mechanisms of execution of court resolutions and acts of other bodies.
Now in administrative legal proceedings the applicant is in unequal position in relation to the defendant - administrative authority, his official given powers of authority. Also the effective mechanism of control of ensuring voluntary execution from state bodies or officials of the court resolution which is taken out on the disputes following from the public relations is not provided.
