About some questions of application by courts of the legislation in case of the dispute resolution following from the insurance contract

For the purpose of ensuring uniform and correct application by courts of the legislation governing the relations in the field of insurance, being guided by article 17 of the Law of the Republic of Uzbekistan "About courts" the Plenum of the Supreme Court of the Republic of Uzbekistan decides:

1. In case of the dispute resolution, following from insurance contracts, courts should be guided by the Civil code of the Republic of Uzbekistan (further - group of companies), the laws of the Republic of Uzbekistan "About the contractual legal base of activities of business entities", "About obligatory civil liability insurance of owners of vehicles", "About obligatory civil liability insurance of the employer", "About compulsory national social insurance from labor accidents and occupational diseases" and "About obligatory civil liability insurance of carrier", the Economic Procedure Code of the Republic of Uzbekistan, the Code of civil procedure of the Republic of Uzbekistan, and also other regulatory legal acts governing the relations in the field of insurance.

2. According to Article 914 of group of companies insurance is performed based on the agreements of property or personal insurance signed by the citizen or the legal entity (insurer) with insurance company (insurer).
