About modification of some legal acts of Ukraine concerning ensuring compliance with the rights and freedoms of the convicts transferred to Ukraine for serving sentence and also persons on whom the competent authority of foreign state made the decision on their issue to Ukraine (extraditions) for criminal prosecution or execution of sentence

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Penitentiary code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2004, Art. No. 3-4, 21):

Article 7 to add 1) with part six of the following content:

"6. Legal status of the convicts transferred to Ukraine for serving sentence and also convicts on whom the competent authority of foreign state made the decision on their issue to Ukraine (extraditions) for criminal prosecution or execution of sentence is determined by the laws of Ukraine and this Code taking into account the conditions of their content defined by the existing international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine";

Article 86 to state 2) in the following edition:

"Article 86. Determination to the convict to imprisonment of type of colony

1. The type of colony in which convicts to imprisonment serve sentence is determined by the central executive body realizing state policy in the field of execution of criminal penalties.

The central executive body realizing state policy in the field of execution of criminal penalties determines the list of colonies in which the convicts to imprisonment transferred to Ukraine for serving sentence and also convicts to imprisonment on whom the competent authority of foreign state made the decision on their issue to Ukraine (extraditions) for criminal prosecution or execution of sentence serve sentence";
