About some questions of construction of facilities financed from the republican budget

For the purpose of the solution of questions of construction of the social objects financed from the republican budget, streamlining of the relations between suppliers of the goods, works and services in the field of construction, state bodies and their subordinated organizations connected with increase in the price of earlier signed agreements or contracts according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. To the state agency of architecture, construction and housing and communal services under the Cabinet of Ministers of the Kyrgyz Republic and to its subordinated organizations:

- sign supplementary agreements in connection with increase in the prices;

- finance additional and unaccounted works in the design estimates in case of their identification during construction;

- terminate agreements or contracts unilaterally in case of refusal of contract organizations from the conclusion of supplementary agreements in accordance with the terms of ensuring financing with treasury obligations.

2. Bring in the Procedure for establishment and confirmation of essential change of the circumstances connected with increase in the price, No. approved by the resolution of the Cabinet of Ministers of the Kyrgyz Republic of November 21, 2022 651, the following change:

- add with Items 7, of 8, 9 following contents:

"7. In case of the conclusion of supplementary agreements to the agreements or contracts connected with construction because of increase in the prices the total amount of the agreement or contract shall not exceed the amount determined in the design estimates without extra and unaccounted works.
