About introduction of amendments to the order of the Minister of Education and Science of the Republic of Kazakhstan of January 16, 2015 No. 14 "About approval of the Regulations on foster education"

1. Bring in the order of the Minister of Education and Science of January 16, 2015 No. 14 "About approval of the Regulations on foster education" (it is registered in the register of state registration of regulatory legal acts No. 10285) the following changes:

in Regulations on the foster education approved by the specified order:

3) the consent of the spouse(s) if person who showed willingness to become the foster tutor is married;

4) the copy of the certificate on marriage if is married;

5) the copy of documents, the confirming property right or right to use by the dwelling;

6) the health declaration of person wishing to become the foster tutor and his spouse(s) if is married, confirming absence of diseases according to the list of diseases in the presence of which person cannot adopt the child, accept it under guardianship or custody, patronage, the approved order of the Minister of health and social development of the Republic of Kazakhstan of August 28, 2015 No. 692 "About approval of the list of diseases in the presence of which person cannot adopt the child, accept it under guardianship or custody, patronage" (it is registered in the Register of state registration of regulatory legal acts at No. 12127), and also certificates of lack of data on condition on accounting in narcological and psychiatric dispensaries according to form, the Minister of Health of the Republic of Kazakhstan approved by the order of May 18, 2020 No. KR DSM-49/2020 "About some questions of rendering the state services in the field of health care" (it is registered in the Register of state registration of regulatory legal acts at No. 20665);

7) the copy of the diploma about education;

8) the certificate of training of child(children) in the organization of education (for children of school age);

9) the certificate on passing of psychological training of the citizens of the Republic of Kazakhstan who are constantly living in the territory of the Republic of Kazakhstan, persons interested to accept orphan children, children without parental support on education in the family in the form approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of April 27, 2020 No. 165 "About approval of requirements to contents of the program of psychological preparation, procedure for the organization of activities for psychological training of the citizens of the Republic of Kazakhstan who are constantly living in the territory of the Republic of Kazakhstan, persons interested to accept orphan children, children without parental support on education in the family and forms of the certificate on passing of such preparation" (it is registered in the Register of state registration of regulatory legal acts at No. 20507) (except for close relatives of the child);

10) the agreement on opening of the current account in bank of the second level;

11) the copies of documents confirming the relationship fact with child(children) (for relatives, the stepfather (stepmother) of child(children).

Provision of the document specified in the subitem 8) the list is not required, in case of accommodation of child(children) in the organizations for orphan children and children without parental support.

Data on availability or lack of criminal record concerning person wishing to take child(children) on foster education and its spouse(s) if the body is married receives from information system of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan.

The body transfers orphan children and children without parental support, to relatives, stepfathers (stepmothers) to foster education according to requirements of Item 1 of article 122 of the Code.";

"26. The amount of fee of foster tutors constitutes thirty five monthly settlement indicators a month taking into account calculation of social assignments.".

2. To committee on protection of the rights of children of the Ministry of Public Education of the Republic of Kazakhstan to provide in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Public Education of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Public Education of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of education of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.
