About modification and amendments in the order of the Minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of October 1, 2020 No. 365/Tax Code "About Approval of Rules of Provision of Innovative Grants on Commercialization of Technologies"

1. Bring in the order of the Minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of October 1, 2020 No. 365/Tax Code "About Approval of Rules of Provision of Innovative Grants on Commercialization of Technologies" (it is registered in the Register of state registration of regulatory legal acts No. 21367) the following changes and amendments:

in Rules of provision of innovative grants on commercialization of the technologies approved by the specified order:

in Item 2:

10) to state the subitem in the following edition:

"10) the applicant – the subject of innovative activities who provided for consideration the request by means of the automated system to national institute on receipt of innovative grant according to these rules;";

add with the subitem 16) of the following content:

"16) joint financing - means of the applicant (grantee) in terms of money, for accomplishment of conditions on joint financing of the project.".

state Item 7 in the following edition:

"7. Services of national institute in provision of innovative grants are paid by authorized body at the expense of means of the republican budget.".

state Item 9 in the following edition:

"9. For participation in tender the applicant by means of the portal provides the following document package in the state or Russian languages:

at 1 stage:

the preliminary offer on receipt of innovative grant in form, according to appendix 1 to these rules;

at the 2nd stage:

1) the complete offer on receipt of innovative grant in form, according to appendix 2 to these rules;

2) the business plan of the project in form, according to appendix 3 to these rules;

3) the draft of the schedule in form, according to appendix 4 to these rules;

4) the project of expense budget with disaggregation of costs in form, according to appendix 5 to these rules;

5) copies of provisional agreements and (or) agreements, including licensed, on supply of equipment (in the presence);

6) copies of transportation agreements (delivery) of the equipment (in the presence);

7) In case of development/completion of software product: the specification on development of software product in which in addition to requirements to software product required specialists, their quantity by specialization with the description of types, amounts, terms and payment of their work are specified;

8) copies of the diplomas and (or) certificates or other documents confirming qualification of team member of the project;

9) financial model of the project in the Excel format.

10) the document confirming completion of the akseleratsionny and (or) business and incubatory program.

For the conclusion of the agreement – the decision of the supreme body on the conclusion of the contract for provision of innovative grant, the decision on granting of power to the head and (or) authorized person to sign the documents connected with receipt of innovative grant.";

state Item 14 in the following edition:

"14. The procedure of provision of innovative grants includes the following stages:

1) the National institute within 1 (one) working day registers the preliminary offer and sends it for consideration to Council.

Council within 8 (eight) working days after registration hears the preliminary proposal of the applicant and performs selection by the following criteria:

innovation;

scalability;

exportooriyentirovannost;

structure and qualification of project team;

business potential of the project.

Following the results of hearing of the preliminary offer, Council makes the decision on the admission (refusal in the admission) the applicant on the second stage of tender;

2) the National institute within 1 (one) working day after receipt of the decision of Council, by means of the portal sends to the applicant who underwent selection, the notification on the made decision according to the admission or refusal in the admission on the second stage.

The term of consideration of the request stops from the moment of sending to the applicant of the notification on the made decision according to the admission on the second stage;

3) the applicant who underwent the selection which received the notification on the admission on the second stage within 10 (ten) working days represents the complete offer to national institute.

In case of non-presentation by the applicant of the complete offer in time, the national institute specified in subitem part one 3) and 4) of Item 14, refuses further review of the request;

4) the National institute within 1 (one) working day performs check on completeness of the submitted documents and registration of complete offers. If in complete of offers the applicant provides not complete document package, the National institute refuses registration of this request and directs the adequate notice by means of the automated system. The applicant repeatedly submits the complete proposal with complete document package within 2 working days. At the same time the National institute refuses further review of the request in case of repeated identifications of incomplete document package.

4-1) The national institute within 4 (four) working days performs verification of the registered complete offers on compliance to requirements of these rules.

The national institute provides protection of information which is trade secret according to article 28 of the Entrepreneurial code of the Republic of Kazakhstan.

By results of check the National institute by means of the portal sends to the applicant the Notification on the revealed notes (in case of their availability)
