About modification in Criminal and Criminal procedural codes of Ukraine in connection with ratification of the Additional protocol to the Convention of the Council of Europe on prevention of terrorism, and also in some legal acts of Ukraine on enhancement of fight against terrorism

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

3 parts one of Article 96-3 and part one of article 96-9 of figure "258-258-5" to replace 1) in Item with figures "258-258-6";

Article 258-4 to state 2) in the following edition:

"Article 258-4. Assistance to making of act of terrorism, training to terrorism

1. Recruitment, arms, training of person for the purpose of making of act of terrorism, and also use of person for this purpose, training to terrorism -

are punished by imprisonment for a period of three up to eight years with confiscation of property or without that.

2. The same actions made concerning several persons (except training to terrorism) either repeatedly, or by previous concert group of persons, or the official with use of the official position, -

are punished by imprisonment for a period of eight up to ten years with confiscation of property or without that.

3. Person is exempted from criminal liability for the act provided by part one of this Article regarding training to terrorism if it voluntarily refused further criminal activities, reported law enforcement agency about this crime, promoted prevention or the termination of the terrorist activities connected with the crime committed by it.

4. The actions provided by part one or the second this Article, which are commited by person, the person performing criminal influence, or being being in the status of the subject of the increased criminal influence, including in the status of "code-bound criminal" -

are punished by imprisonment for a period of twelve up to fifteen years with confiscation of property.
