About modification of some regulations (about implementation of the Protocol No. 16 to the Convention on human rights protection and fundamental freedoms)

Art. I. - Article 4 of the Law on the Constitutional court No. 317/1994 (1995, No. 8, Art. 86), with subsequent changes, to add the official monitor of the Republic of Moldova with part (3) the following content:

"(3) When implementing the constitutional jurisdiction the Constitutional court can make in the European Court of Human Rights inquiries about issue of the advisory proceeding on the matters of principle concerning interpretation or application of the rights and fundamental freedoms provided by the Convention on human rights protection and fundamental freedoms or protocols to it.".

Art. II. In the Law on the Government representative No. 151/2015 (Official monitor of the Republic of Moldova, 2015, Art. No. 224-233, 455), with subsequent changes, to make the following changes:

1. Part (Article 5 to add 4) with Item g) the following content:

"g) represents if necessary written notes and participates in hearings in the course of consideration of request by the European Court of Human Rights about issue of the advisory proceeding submitted competent national instance.".

2. Add Article 20 with part (2-1) following of content:

"(2-1) Government representative provide transfer into Romanian of the advisory proceedings of the European Court of Human Rights issued as a result of the inquiries sent by national instances of the Republic of Moldova and publishes them on the official web page of the Government representative.".
