About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:
1. To add the name of article 59 after the word of "responsibility" with words of "physical person".
2. Add the code with Article 59-1 of the following content:
"Article 59-1. Conditional release from criminal liability of the legal entity
Concerning the legal entity with whom the judicial agreement approved by degree of jurisdiction in public concerns is signed criminal prosecution with the subsequent release it from criminal liability according to the criminal procedure in case of accomplishment by the legal entity of terms of agreement and the expiration of the observation term established in the agreement can be conditionally stopped.".
3. Add Article 60 with part (5-1) following contents:
"(5-1) Prescriptive limit stop for the period of suspension of criminal prosecution.".
4. State Article 80 in the following edition:
"Article 80. Application of punishment in case of agreement signature about recognition of fault
If the person accused signed the agreement on recognition of fault and degree of jurisdiction this agreement, limits of the punishment prescribed by the Special part of this Code is accepted are reduced by one third.".
5. Add the code with Article 80-1 of the following content:
"Article 80-1. Application of punishment in case of legal proceedings based on the proofs collected at stage of criminal prosecution
(1) to the Defendant who was recognized making of the acts specified in the indictment and demanded carrying out legal proceedings based on the proofs collected at stage of criminal prosecution are reduced by quarter by the prescribed Special part of this Code limits penalties imposed in the form of penalty, unpaid work for benefit of society or condemnation to imprisonment.
