"Article 445.1. Procedure for turn of execution of the court decree cancelled on again opened or new circumstances

1. In case of cancellation of the court decree on again opened or new circumstances in the new court decree accepted as a result of trial de novo which the court finally resolves dispute either stops proceeedings, or leaves the statement without consideration, the question of turn of execution of the court decree shall be resolved.

2. If in the new court decree there are no instructions on the turn of execution of the court decree, faces participating in the case having the right to submit the corresponding lawsuit to the court of the first instance.

3. In case of cancellation of the court decree on again opened or new circumstances on cases on collection of sums of money on the requirements following from employment relationships, about collection of remuneration for use of the rights to works of science, literature and art, execution, opening, the invention, useful models, industrial designs, about collection of the alimony, about indemnification, caused by mutilation or other damage of health or the death of the supporter, the turn of execution of the court decree is not allowed in the absence of established facts of the message by the claimant of false data or submission of false documents to them.".
