1. Bring in the Instruction about procedure for making of notarial actions approved by the resolution of the Ministry of Justice of the Republic of Belarus of October 23, 2006 No. 63, the following changes:
state Item 35 in the following edition:
"35. Alienation of the premises (share in the property right to premises) belonging on the property right to minors aged up to fourteen years to the citizens recognized incapacitated or limited in capacity to act to court and also the minors aged from fourteen up to eighteen years which is under guardianship including in case of their device on the state providing in the child care residential care facilities, public institutions of education realizing educational programs of professional, secondary vocational, higher education, the educational program of training of persons for receipt in organizations of formation of the Republic of Belarus, orphanages of family type, in tutorial, foster homes is performed only after receipt of written consent of guardianship and custody body.";
add the Instruction with Item 35-1 of the following content:
"35-1. Alienation by the owner of premises in which minor members, the being members of his family live acknowledged being in socially dangerous family way or recognized as persons in need in the state protection, or the citizens recognized incapacitated or limited in capacity to act to court, or the premises assigned to orphan children or children without parental support is allowed only from written consent of guardianship and custody body.
