About modification of some legal acts of Ukraine concerning enhancement of legal regulation of making of notarial and registration actions in case of acquisition of rights the parcels of land

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

1) in Article 87 part one:

in" to state the Items "" and" in the following edition:

"b) in case of acquisition in common partial property of the parcel of land under civil agreements;

c) in case of inheritance acceptance on the parcel of land";

add with the Item "g" of the following content:

"d) in other cases established by the law";

The first and second Article 89-1 to state 2) to part in the following edition:

"1. If according to the law the property right of person who transferred the property to direct trust stops, the incorporated trustee has the rights and fulfills duties of the owner of the parcel of land taking into account the features provided by this Code and the Civil code of Ukraine.

2. From the date of acquisition of right by person of the right of direct trust to the parcel of land (if according to the law the property right of person who transferred the property to direct trust stops) pass all rights and obligations of the owner of the parcel of land according to current agreements of lease, emphyteusis, superficies, agreements on establishment of land easement to the incorporated trustee.

The incorporated trustee of the parcel of land, if it is provided by the agreement under which the direct trust is established and if according to the law the property right of person who transferred the property to direct trust stops, can give the parcel of land to use to the third parties only on the lease right with the following features:

the lease term of the earth stops from the moment of the address of collection on the parcel of land;
