About modification of some legal acts of the Kyrgyz Republic (in the Criminal code of the Kyrgyz Republic, the Code of the Kyrgyz Republic about offenses)

Article 1.

Bring in the Criminal code of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

Article 71 to add 1) with part of 1-1 following content:

"1-1. In case of unauthorized occupation of lands by court as compensation of material harm measures are taken:

1) on ensuring return of self-willedally taken parcel of land and elimination of effects of unauthorized capture;

2) on elimination of effects of reduction of lands in unsuitable for use in agricultural production condition.";

2) in Article 212:

a) to state paragraph two of part 1 in the following edition:

"it is punished by penalty from 1000 to 2000 settlement indicators.";

b) to state paragraph two of part 2 in the following edition:

"are punished by imprisonment for a period of five up to seven years.";

c) to state paragraph two of Item 2 of part 3 in the following edition:

"are punished by imprisonment for a period of seven up to ten years.";

d) state part 4 in the following edition:

"4. The organization or management of unauthorized capture of the parcel of land and unauthorized construction on lands with violation of their purpose -

are punished by imprisonment for a period of ten up to twelve years";

The Code to add 3) with Articles 212-1 and 212-2 of the following content:

"Article 212-1. Rejection of measures for non-admission of unauthorized occupation of lands

1. Rejection by the official, land owner of measures for non-admission of unauthorized occupation of lands -

it is punished by penalty from 300 to 700 settlement indicators or imprisonment for a period of up to three years with deprivation of the right to hold certain position, or to be engaged in certain activities for a period of up to three years.
