About modification of some legal acts of Ukraine concerning enhancement of the procedure of conclusion from the market of bank in the conditions of warlike situation

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. The Section X "Final provisions" of the Economic Procedure Code of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with Item 5 of the following content:

"5. Determine that the only way of protection of the rights of persons which suffered damage, losses owing to conclusion from the market of systemically important bank on the bases, certain Item 15 of the Section VII "Final provisions" of the Law of Ukraine "About banks and banking activity" is compensation of damage suffered, losses in the procedure provided by rules of international law only at the expense of means of the state (states) which performed (performed) or performing (performing) the armed aggression against Ukraine in the value given in the Law of Ukraine "About defense of Ukraine".

2. The Section VI "Final provisions" of the Code of administrative legal proceedings of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with item 4 of the following content:

"4. Determine that provisions of Article 266-1 of this Code extend to production on cases on appeal of individual acts of the National Bank of Ukraine on conclusion from the market systemically of important bank on the bases, certain Item 15 of the Section VII "Final provisions" of the Law of Ukraine "About banks and banking activity", taking into account the features established by this Item.

By results of consideration of administrative case about legality of the individual acts of the National Bank of Ukraine specified in paragraph one of this Item, the court accepts one of the following decisions:

1) about recognition illegal (illegal) and cancellation of the individual act determined by paragraph one of this Item, or its separate provisions;
