1) in Article 40:

a) state part 1 in the following edition:

"1. The parties of the concessionary agreement which subject are heat supply objects centralized systems of hot water supply, cold water supply and (or) water disposal, separate objects of such systems, the concessionary cannot be:

1) the foreign legal entity (including by means of the conclusion of the property trust management agreement according to the Civil code of the Russian Federation), the organizations and other corporate education having civil legal capacity, created according to the legislation of foreign state, not having accredited branch, representation in the territory of the Russian Federation or two and more legal entities who act under the agreement of particular partnership (cooperation agreement) and among whom there are specified foreign legal entities;
