About modification and amendments in the Presidential decree of the Republic of Kazakhstan of November 11, 2019 No. 203 "About further enhancement of system of public administration of the Republic of Kazakhstan"

I DECIDE:

1. Bring in the Presidential decree of the Republic of Kazakhstan of November 11, 2019 No. 203 "About further enhancement of system of public administration of the Republic of Kazakhstan" the following changes and amendments:

in Regulations on the Agency of the Republic of Kazakhstan on regulation and development of the financial market approved by the above-named Decree:

in Item 14:

add with subitem 2-1) of the following content:

"2-1) establishment of conditions and approval procedure on carrying out reorganization of the Voluntary accumulation pension fund, determination of features of carrying out reorganization of the Voluntary accumulation pension fund with participation of the state, national welfare fund and (or) authorized body;";

add with subitem 12-1) of the following content:

"12-1) carrying out digital transformation of the Agency;";

add with subitems 51-4), 51-5) and 51-6) of the following content:

"51-4) determinations of procedure and features of participation of the insurer in investments or profit of the insurer, the conclusion by branch of the insurance nonresident organization of the Republic of Kazakhstan of the insurance contract providing condition of participation of the insurer in investments or profit of the insurer, requirements to contents of the insurance contract providing condition of participation of the insurer in investments or profit of the insurer;

51-5) determinations of conditions and procedure for transfer by insurance company of the assets created at the expense of part of the insurance premiums (insurance premiums) got from insurers for the purposes of investment and income (expenses) gained (suffered) from their investment, according to the insurance contracts providing condition of participation of the insurer in investments in investment management to the managing director of investment portfolio not being insurance company;
