About modification of the Regulations on implementation of financial monitoring by banks

According to Articles 7, of 15, of 55, 56 Laws of Ukraine "About the National Bank of Ukraine", article 18 of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" for the purpose of settlement of single questions of implementation of financial monitoring of Board of the National Bank of Ukraine DECIDES:

1. Bring in appendix 9 to the Regulations on implementation of financial monitoring by banks approved by the resolution of Board of the National Bank of Ukraine of May 19, 2020 No. 65 (with changes), the following changes:

3 Items of the 16th figure and the word "200", "quarter" to replace 1) in the subitem respectively with figures and the word "400", "month";

Appendix after Item 16 to add 2) with new Item 16-1 of the following content:

"16-1. The bank shall provide proper application risk - the oriented approach to establishment of the business relations / in holding time of clients, being RER ѕ, for the purpose of assignment of reasonable risk level by it, prevention of groundless refusal to such clients in carrying out financial transactions and/or establishment (continuation) of business relations.

The bank bears responsibility for inadequate application to clients who are RER ѕ, risk - the oriented approach, including establishment of unreasonable risk level by it and/or acceptance concerning them disproportionate measures according to category of risk.".
