About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Law on protection of atmospheric air No. 1422/1997 (Official monitor of the Republic of Moldova, 1998, Art. No. 44-46, 312), with subsequent changes, to make the following changes:
1. State Article 12 in the following edition:
"Article 12. Permission to emission of pollutants by stationary sources of pollution
(1) the Right to operation of all installation or its part and/or to implementation of one of the types of industrial and economic activity with significant risk of pollution of atmospheric air provided in appendix 2, or with low contamination hazard of atmospheric air, provided in appendix 3, is provided only based on permission to emission of pollutants in the atmosphere by stationary sources of the pollution (further - permission) issued by the Agency of the environment - body issuer of allowing documents in the field of the environment (further - body issuer).
(2) the Physical persons and legal entities intending to operate installation and/or to perform one of the types of industrial and economic activity provided in appendix 2 or appendix 3, shall address to body issuer and get permission.
(3) the Request for permissions and their issue are made:
a) when commissioning new installations and/or in case of initiation of new types of activity;
b) for operation of the existing installations and/or maintaining the existing types of activity.
(4) in case of the request for permission when commissioning new installations or in case of initiation of new types of industrial and economic activity, behind the permission to operate of the existing installations and/or on maintaining the existing types of activity on which permissions were not issued earlier or in which there were changes in engineering procedures, the number of emissions, functionality and capacity of sources of pollution the applicant submits the following documents by means of the Automated information system of production and issue of allowing documents:
