Chapter I. General provisions

Article 1. Service of information and safety of the Republic of Moldova

(1) the Service of information and safety of the Republic of Moldova (further - Service) is autonomous administrative authority on which responsibility for safety of the Republic of Moldova is conferred.

(2) the Purpose of activities of Service is ensuring internal and external security of the state, protection of the constitutional system, contribution to protection of national economic system and to ensuring defense capability, fight against terrorism and other threats for state security with use of preventive and special means of not military nature.

(The Service plans 3), will organize and performs activities for collection, check, assessment, accumulating, preserving and use of information necessary for protection of the constitutional system, providing and protection of basic rights and freedoms, and also for identification, the prevention and counteraction to vulnerabilities, risk factors and threats which undermine or can undermine safety of the Republic of Moldova.

(4) Activities of Service are coordinated by the President of the Republic of Moldova according to the Law on state security No. 618/1995 and is subject to parliamentary control.

(5) the Service is body of the public power, has the official and commonly accepted name - SIB, and also has other attributes.

Article 2. Principles of activities of Service

Activities of Service are performed on the basis of the following principles:

a) legality;

b) observance of basic rights and freedoms;

c) independence and impartiality;

d) extra party membership and political neutrality;

e) feasibility, succession and sequence;

f) combination of public and secret methods and means of activities;

g) proportionality.

Chapter II. Functions, activities, obligations and powers of service

Article 3. Functions of Service

For the purpose of ensuring state security, identification, decrease or suppression of vulnerabilities, risk factors and threats for safety of the Republic of Moldova Service:

1) performs collection, check, assessment, the analysis, accumulating, storage and use:

a) information important for safety of the Republic of Moldova for preserving and development of its scientific, economic, defense potential and human resources, for carrying out domestic and foreign policy;

b) information necessary for identification, the prevention and suppression of prospecting subversive activities of special services of other states, anticonstitutional subjects or structures, and also separate groups or persons whose actions are directed to undermining state security;

Develops 2) and realizes system of the measures directed to identification, the prevention and suppression within the competence:

a) the actions and/or failure to act directed to making of the following acts, and also their making:

- violent change of the constitutional system, implementation of the subversive activities or other actions directed to violent overthrow of bodies of the public power and public organizations, blasting or destruction in any form of sovereignty, independence or territorial integrity and unity of the state;

- capture of the government;

- the incitement of hatred on racial, national, religious, social features which is followed by violence or instigation to violent acts;

- the activities implementation directly or indirectly promoting expansion of fighting against the Republic of Moldova, to occupation of the state by foreign armed forces, easing of defense capability or capability of safety of frontier, service of the foreign power or initiation of war, the internal or international military conflicts, implementation of other violent acts undermining existence, stability and sustainable development of the state;

- implementation of the actions and assumption of the premises promoting, determining or able to cause serious or irreparable damage to national objects in the field of transport and communication, power system, information systems or systems of electronic communications, in the bank financial market, in tax, customs or investment areas, in primary branches of national economy, to their external relations or objects of critical infrastructure;

- treachery of the homeland, espionage, activities of illegal information structure, plot against the Republic of Moldova, illegal information collection, separatism;

- emergence of cyberthreats or cyberincidents in information networks and systems of national value;

- emergence of the hybrid threats to the state expressed in actions/failure to act at national, regional or world level, affecting stability of the state and also in the promotional hostile campaigns or campaigns for misinformation capable to undermine the constitutional system;

- plunder, smuggling, production, use, transportation or illegal storage of weapon, ammunition, military equipment, the explosive, radioactive, poisoning or toxic substances, drugs, strategic goods if these actions affect national security;

- implementation of terrorist activities, any form of support of these activities, other extremist activities, promotion of the terrorist and extremist ideas and values;
