About selection of judges and assessment of their activities

Chapter I General provisions

Article 1. Subject of the law

This law regulates the principles and the procedure of candidate screen for position assignment of the judge, the principles and assessment procedure of activities of judges, and also procedure for the organization and functioning of Board on selection and assessment of judges.

Article 2. Principles of selection and assessment of judges

Selection and assessment of judges are based on the following principles:

a) legality;

b) nondiscrimination;

c) objectivity and impartiality in case of selection and assessment;

d) justice;

e) transparency;

f) confidentiality;

g) personal data protection and private life;

h) respect of human dignity.

Chapter II Candidate screen on judgeship

Article 3. Selection criteria of candidates for judgeship

(1) Candidates for judgeship who correspond to the requirements established in article 6 of the Law on the status of the judge No. 544/1995 are selected based on the following criteria:

a) results of the National institute of justice of examination which is carried out by the Commission on acceptance of final examinations upon termination of rates of elementary training or in appropriate cases of examination for persons who proposed the candidates for judgeship or the prosecutor on the basis of working life;

b) work experience as the specialist in the field of the right and type of the activities performed in the corresponding positions;

c) participation in actions, projects or initiatives within informal education;

d) knowledge of one of official languages of the Council of Europe;
