About modification in Criminal and Criminal procedural codes of Ukraine concerning elimination of contradictions in punishability of criminal offenses

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

1) in part four of article 68 of figure "109-114-2" to replace with figures "110, 111, 111-1, 112, 113";

2) in Article 91-1:

in Item to exclude 5 parts of the first word "or probatsionny program";

the fourth to exclude part;

Article 113 part two paragraph two after words "imprisonment" to add 3) with the word "on";

The second parts five of Article 143 of the word "with deprivation of the right to hold certain positions and to be engaged in certain activities" shall be replaced with words 4) in the paragraph "with deprivation of the right to hold certain positions or to be engaged in certain activities";

5) in the paragraph the second part four of Article 159-1 of the word "restriction of freedom for the term of five years" shall be replaced with words "restriction of freedom for a period of two up to five years";

Article 190 to state 6) in the following edition:

"Article 190. Fraud

1. Occupancy by someone else's property or acquisition of right to property by deception or confidence abuses (fraud) -

it is punished by penalty from two thousand to three thousand free minima of the income of citizens or social jobs for a period of two hundred till two hundred forty o'clock, or corrective works for a period of up to two years, or restriction of freedom for a period of up to three years.

2. Fraud, committed repeatedly, or by previous concert group of persons, or it that caused significant damage to the victim, -

it is punished by penalty from three thousand to four thousand free minima of the income of citizens or corrective works for a period of one up to two years, or restriction of freedom for a period of up to five years, or imprisonment for a period of up to three years.
