The purpose of this Law is regulation of the relations in the field of establishment, changes, protection and protection of Frontier of the Republic of Uzbekistan.
The legislation on Frontier of the Republic of Uzbekistan consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation about Frontier of the Republic of Uzbekistan then are applied rules of the international treaty.
Frontier of the Republic of Uzbekistan (further - Frontier) is the line and the vertical surface passing across this line, the determining limits of the territory of the Republic of Uzbekistan (sushi, waters, subsoil and airspace).
In this Law the following basic concepts are applied:
protection of Frontier - complex office and fighting, office prompt actions, control, operational search and regime actions;
protection of Frontier - the component of system of ensuring national security of the Republic of Uzbekistan performed by acceptance of political, organization-legal, diplomatic, economic, defense, boundary, operational search, customs, nature protection, sanitary and epidemiologic, phytosanitary, quarantine and other measures for safety of Frontier and territorial integrity of the Republic of Uzbekistan;
the check point through Frontier (further - the check point) - specially equipped territory (its part) of border railway stations and automobile ways, river ports, airports (airfields) open for the international messages where control procedures concerning persons and vehicles crossing Frontier and also the goods moved through Frontier, and their omission through Frontier are performed;
state control bodies at check points through Frontier (further - state control bodies) - Border troops of Service of state security of the Republic of Uzbekistan, customs authorities, service of sanitary and epidemiologic wellbeing and public health, the public veterinary service, public service on quarantine and protection of plants exercising control concerning persons and vehicles crossing Frontier and also the goods moved through Frontier;
delimitation - determination of the line of Frontier, the description of its passing and graphical representation on the card according to the international treaties of the Republic of Uzbekistan signed between the Republic of Uzbekistan and the adjacent states;
demarcation - designation of the line of Frontier on the area by establishment of border markers according to the international treaties of the Republic of Uzbekistan on delimitation concluded between the Republic of Uzbekistan and the adjacent states;
control procedures - package of measures, performed within their powers by state control bodies, concerning persons and vehicles crossing Frontier and also the goods moved through Frontier;
redemarkation - recovery of the line of Frontier on areas and designation by its border markers according to international treaties of the Republic of Uzbekistan, and also recovery lost, installation of additional border markers with execution of the relevant documents by agreement with the adjacent states which are specially created by the intergovernmental commissions;
thalweg - the line connecting the deepest sites of bottom of bed of the river which can be used for establishment of Frontier on the navigable river;
waterway - safe ship pass in the navigation relation on water space;
implementation of economic and other activity - use of boundary reservoirs of the Republic of Uzbekistan, construction of hydroconstructions, use of lands, plant and animal life for agriculture, cattle breedings, productions, implementation of research, prospecting works, conducting mining, geological researches and implementation of other activities;
border area - the border territory or its part adjacent to borderland where the boundary regime is introduced;
borderland - part of the border territory directly adjacent to Frontier where the Frontier regime is introduced;
border duty - one or several servicemen who are carrying out task on protection and protection of Frontier;
the border territory - the territory within administrative and territorial unit (the area, the city), adjacent to Frontier.
The basic principles of establishment, change, protection and protection of Frontier are:
legality;
ensuring compliance with national interests of the Republic of Uzbekistan;
mutual respect of sovereignty, territorial integrity, immunity and inviolability of frontiers of the states;
peaceful resolution of boundary questions;
full cooperation with foreign states on equal and mutually advantageous basis;
non-interference to internal affairs of foreign states;
nonuse of force and threats of force.
Establishment and change of Frontier is performed by chambers of Oliy Majlis of the Republic of Uzbekistan according to international treaties of the Republic of Uzbekistan. The frontier is subject to delimitation, demarcation and redemarkation.
Consideration of the questions connected with delimitation, demarcation and redemarkatsiy Frontier is performed by the intergovernmental commission consisting of representatives of the Republic of Uzbekistan and the adjacent states. The list of representatives of the Republic of Uzbekistan in the intergovernmental commission and procedure for their activities are determined by the decision of the President of the Republic of Uzbekistan.
The frontier is established:
on the land - on characteristic points, lines of relief or it is clear to visible places (reference points);
on the navigable rivers - on the middle of the main waterway or thalweg of the river;
on the non-navigable rivers (streams) - on their middle or on the middle of the main sleeve of the river (stream);
on the boundary rivers, lakes and other reservoirs - in a straight line, the Frontier connecting exits to coast of the lake or other reservoir. At the same time the Frontier passing down the river to stream, the lake or other reservoir, does not move as in case of change of outline of their coast or water level, and in case of variation of bed of the river, stream to this or that party;
on water storage basins and other artificial reservoirs - according to the line of the Frontier passing on this area before their filling;
on the bridges, dikes and other constructions passing through the boundary rivers, lakes or other reservoirs - on the middle of these constructions or on their technological axis irrespective of passing of Frontier on water.
The frontier on the area is designated clearly by visible border markers.
Forms, the sizes, descriptions, designs and procedure for establishment of border markers are determined by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan and international treaties of the Republic of Uzbekistan.
Just for show Frontier between the adjacent states on places on all extent of border, and also along external borders of the water protection zones of the boundary rivers, lakes and other reservoirs according to their technical characteristics the cleaning strip is established.
The strip of cleaning is established at least five meters wide within which any activities which are not connected with establishment, change, arrangement, protection and protection of Frontier are prohibited.
