About modification of the Customs code of Ukraine concerning reduction of the Procedure for determination of the country of goods' origin in compliance with the Customs code of the European Union and ensuring implementation of agreements of Ukraine on free trade

The Verkhovna Rada of Ukraine decides:

I. Bring in the Customs code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2012, Art. No. No. 44-48, 552) such changes:

1. In Item 7 parts seven of Article 33-1 of the word "name of country of source" shall be replaced with words "origin country name".

2. State the Section II in the following edition:

"Section II country of goods' origin

Chapter 6. Country of goods' origin and criteria of sufficient conversion of goods. Documents on goods origin

Article 36. Determination of the country of goods' origin

1. Provisions of this Code establish neproferentsionny rules by determination of the country of goods' origin, moved through customs border of Ukraine, for the purpose of application:

1) duty rates, rules on its collection to goods to which the mode of the greatest assistance, except the tariff privileges (preferences) established by international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine is provided;

2) measures of non-tariff regulation of foreign economic activity;

3) other measures according to requirements of the World Trade Organization connected with determination of the country of goods' origin.

2. Is considered the country of goods' origin the country in which:

1) the goods were completely received;

2) the goods were subjected to the last economically reasonable production and technological operations on conversion which led to production of new goods or are important production stage, on condition of accomplishment in this country of criteria of sufficient conversion which list is established by the Cabinet of Ministers of Ukraine.
