About modification of some regulations (ensuring transfer of obligations according to the Law on modification of some regulations No. 178/2020)

The Parliament adopts this organic law.

Art. I. - In the Law on National Bank of Moldova No. 548/1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes to make the following changes:

1. Part (Article 11-1 to state 1) in the following edition:

"(1) To final permission of case in administrative court execution of the acts of National Bank concerning area of monetary and monetarist policies, including protective measures or measures for financial stabilization, acts of National Bank of use of tools of the resolution, of establishment of the procedure of improvement, correction, special and/or temporary management of the subjects which are under the supervision of National Bank of suspension or revocation of license, permissions, the conclusions, approvals or confirmations issued to the subjects which are under the supervision of National Bank about suspension of operations or exception of the register of the subjects which are under the supervision of National Bank about initiation of the procedure of involuntary liquidation of banks or insurance or reinsurance companies, the acts of National Bank adopted in the course of assessment and supervision of quality of shareholders/participants and persons cannot be suspended holding executive positions in the subjects which are under the supervision of National Bank, and also the acts and measures executed by National Bank, the special managing director or the liquidator during the bank resolution, the resolution of insurance or reinsurance company or during involuntary liquidation of bank, safety or reinsurance society.".

2. Parts (2) and (articles 25 after words "The law on improvement of banks and the bank resolution" to add 3) with the words "both Law on insurance and reinsurance activity No. 92/2022".

3. In Article 75-1:

in part (1) the words "banks/organizations on currency exchange" shall be replaced with words "the subject's person under surveillance";
