About introduction of amendments to article 10 of the Law on entrepreneurship and the companies No. 845/1992

The Parliament adopts this organic law.

Art. I. - In article 10 of the Law on entrepreneurship and the companies No. 845/1992 (Monitor of Parliament of the Republic of Moldova, 1994, No. 2, of the Art. 33), with subsequent changes, to make the following changes:

state Item 6 in the following edition:

"6. On the companies which gained income owing to the wrong reflection of product cost, selling price of goods, property, amount of construction works and rates for the rendered services and non-compliance by that with the regulations regulating forming and use of the prices in the economic relations with bodies of the public power the penalty in the amount of 10 to 20 percent of the amount equivalent to this income is imposed. The corresponding income and the imposed penalties are collected in the government budget based on the decision made by Audit Chamber or the administrative authority of financial inspection subordinated to the Ministry of Finance.

The company to which the sanction is applied has the right to 50 percent reduction of the amount of the imposed penalty if within three working days from the moment of receipt of the decision on application of the sanction pays completely the amount of the corresponding income and 50 percent of the amount of the penalty specified in the decision.";

"8. The penalty in the amount of 10 to 20 percent of the amount of exceeding of income gained in case of application of the trade allowance in the set limits which is applied to officials, and penalty in the amount of 40 to 60 percent of the amount of exceeding of income gained in case of application of the trade allowance in the set limits which is applied to the companies performing business activity is imposed on the companies which applied the trade allowance on socially important goods which exceeds the limit established by the regulations regulating pricing of realization on socially important goods.
