About modification of some regulations (providing department and certification of operators of the transferring system of natural gas)

The Parliament adopts this organic law.

Art. I. - In the Natural Gas Act No. 108/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 193-203, 415), with subsequent changes, to make the following changes:

1. In part (8) Article 9 of the word of "decisions of the Agency" shall be replaced with words "decisions of the Agency, except for the resolutions provided by part (9) article 214 of the Administrative code No. 116/2018,".

2. In Article 17:

in part (1) words "Items a), b) and i) parts (2)," shall be replaced with words "Items a), b), i) and j) parts (2),";

part (to add 2) with Item j) the following content:

"j) non-compliance by the owner of the license of the legal requirements concerning department, independence and/or certification of the operator of the transferring system.".

Art. II. - Article 214 of the Administrative code of the Republic of Moldova No. 116/2018 (2018, Art. No. 309-320, 466), with subsequent changes, to add the official monitor of the Republic of Moldova with part (9) the following content:

"(9) are not subject to suspension of the resolution of the National agency on regulation in power about withdrawal of licenses for non-compliance by their owners in the sector of natural gas of the legal requirements concerning department, independence and/or certification of the operator of the transferring system as well as the resolutions accepted for the purpose of ensuring uninterrupted transfer of natural gas.".

Art. III. - In the article VI of the Law on modification of some regulations No. 249/2022 (The official monitor of the Republic of Moldova, 2022, Art. No. 251-256, 511) to make the following changes:
