About introduction of amendments to the Law on payment for environmental pollution No. 1540/1998

This law shifts subitems (a), (b), (c) and (ii) of Item 1, Item 2, Item 2b of Article 3, and also Article 7 (4) Directives 94/62/EU of the European parliament and Council of December 20, 1994 about packaging and waste of the packaging published in the Official magazine of the European Union by L 365 of December 31, 1994 with the subsequent changes made by the Directive (EU) 2018/852 European parliament and Council of May 30, 2018 about changes of the Directive 94/62/EU on packaging and waste of packaging.

Art. I. - In the Law on payment for environmental pollution No. 1540/1998 (Official monitor of the Republic of Moldova, 1998, Art. No. 54-55, 378), with subsequent changes, to make the following changes:

1. In Article 3:

state the concepts "primary package", "composite primary package" and "secondary package" of the following edition:

"primary package - packaging, held for use as commodity unit the end user or the consumer in outlet;

composite packaging - the packaging made of two or more layers of the different materials, not separable manually forming one integral unit consisting of internal reservoir and external cover which is filled, warehoused, transported and is devastated as such;

secondary package - the packaging intended for education in outlet of group of commodity units irrespective of whether it is on sale as such to the end user or the consumer or serves only as means for filling of shelves in outlet. The secondary package can be separated product without violation of its characteristics;";

add Article with concepts of the following content:

"packaging - the product made of materials of any nature, intended for content of goods and their protection during loading, representation and delivery against the producer to the end user or the consumer and for use as primary package, secondary package, packaging for realization or tertiary packaging;

packaging for realization - the packaging intended for filling in outlets;
