About provision of tax and customs privileges for import and/or delivery of the goods and/or services intended for project implementation "Solid waste in the Republic of Moldova"

The Parliament adopts this organic law.

Art. 1. - In departure from provisions of the Tax code No. 1163/1997, of the Customs code No. 1149/2000, of the Customs code No. 95/2021, of the Law on customs tariff No. 1380/1997, of the Law on approval of the Combined commodity nomenclature No. 172/2014 and the Law on payment for environmental pollution No. 1540/1998, for the purpose of implementation of the "Solid Waste in the Republic of Moldova" Project realized based on the Credit agreement between the Republic of Moldova and the European Bank for Reconstruction and Development, on the amount of 25000000 euros, signed in Chisinau on January 4, 2023, and Agreements on grant between the Republic of Moldova and the European Bank for Reconstruction and Development on financing of the investment projects aimed at the development of infrastructure in the field of management of solid waste, on the amount of 5600000 euros, signed in Chisinau on March 30, 2023, are exempted from the VAT without the deduction right, from excises, customs duty, collection for implementation of customs procedures and payment for goods which in the course of use cause environmental pollution, commodity importation and/or the services intended for implementation of the specified project and also from payment of the VAT with the deduction right, from excises and payment for goods which in the course of use cause environmental pollution, deliveries of the goods and/or services intended for implementation of the specified project. The procedure for application of the corresponding tax and customs privileges is established by the Government.
